Where a 9G actually gets stuck: the order, the employer and the salary

A 9G is not a stand-alone visa. It hangs on an employment relationship, and the sequence is fixed: first the AEP (Alien Employment Permit from the Department of Labor and Employment, DOLE), which includes a publication period; then the 9G itself at the Bureau of Immigration, filed on the strength of that AEP. AEP first, then 9G — the order cannot be reversed, and without the AEP there is no way into the 9G. The petition is filed by the employer, not the employee, and the employer must be SEC-registered and BIR-registered. Applications that stall usually do so at one of three points: the salary is below the standard for the position, the employer is not properly registered, or the applicant is “affiliated” with a company that does not really employ them.

Frequently asked questions

Which comes first, the AEP or the 9G?

The AEP first — the Alien Employment Permit from DOLE. Only once it is issued can the 9G petition be lodged with the Bureau of Immigration. The order cannot be reversed: the AEP is a prerequisite for the 9G, and without it the 9G petition will not be accepted.

Can I apply for a 9G visa myself?

No. The 9G is petitioned by the employer, not the foreign employee; you cannot lodge it in your own name. The employer must be a legitimately registered company, with SEC registration and BIR tax registration in order, or it does not qualify as a petitioner.

Do I need a new 9G if I change employers?

Yes. A 9G is tied to a specific employer. Moving to a new company means a fresh AEP and 9G under the new employer, while the old visa is cancelled or converted per the Bureau’s rules. Plan the handover of your status in advance so there is no gap.

Can I leave the Philippines while my 9G is being processed and my passport is with the Bureau?

It depends on the stage. At some stages you can ask for your passport back or obtain permission to travel; at others leaving is not advisable. What applies to you depends on your case and the Bureau’s rules at the time — check before booking anything.

My employer closed down. Is my 9G still valid?

Not indefinitely. Once the employment relationship ends, your status lapses at a defined point. Verify your current standing as soon as possible and arrange either a conversion to another visa or your departure; delay can leave you overstaying.

Why do 9G processing times vary so much?

The difference comes from whether the documents are complete on first filing, the DOLE publication period, and the Bureau’s queue at the time.
